Terms of Service

1. Parties & Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between:

• "GoKenyaHub" (also "we", "us", "our") — GoKenyaHub Limited, the operator of the website at https://gokenyahub.com and all associated services; and
• "User" (also "you", "your") — any individual or entity accessing or using the GoKenyaHub platform.

By creating an account, making a purchase, or otherwise using GoKenyaHub, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

To use GoKenyaHub, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract in your jurisdiction
• Not be prohibited from using our services under applicable law
• Provide accurate and truthful registration information

If you are registering on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

3. Account Registration & Security

3.1 Registration

You must provide a valid email address and verify it via a One-Time Password (OTP) to activate your account. You agree to provide accurate, current, and complete information and to update it as necessary.

3.2 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your password and Multi-Factor Authentication (MFA) credentials
• All activities that occur under your account
• Notifying us immediately at support@gokenyahub.com of any unauthorised access or security breach

GoKenyaHub will not be liable for any loss or damage arising from your failure to protect your account credentials.

3.3 One Account Per User

Each individual may only register one account. Creating multiple accounts to circumvent restrictions, exploit promotions, or for any other deceptive purpose is a material breach of these Terms.

4. Our Services

GoKenyaHub provides:

• ATS-optimised CV templates and career resources for Kenyan professionals seeking UK employment
• UK visa and immigration guides (Skilled Worker Visa, NHS pathways, etc.)
• UK salary calculators, job trackers, and productivity tools
• Educational courses and academy content
• A community platform including blog articles, comments, and WhatsApp group access
• Premium downloadable digital products via our shop
• Support chat for registered users

5. Digital Products & Downloads

5.1 Licence Grant

Upon successful payment, GoKenyaHub grants you a personal, non-exclusive, non-transferable, revocable licence to download and use the purchased digital product for your individual, non-commercial use only.

5.2 Restrictions

You may not:

• Resell, redistribute, sublicense, or share paid digital products with third parties
• Remove or alter any copyright notices or branding from our materials
• Use our products to create competing products or services
• Upload our materials to file-sharing platforms or social media for others to access without purchase

6. Payments, Refunds & Cancellations

6.1 Pricing

All prices are displayed in British Pounds Sterling (GBP) unless otherwise stated. GoKenyaHub reserves the right to change prices at any time. Price changes will not affect orders already confirmed.

6.2 Payment Processing

Payments are processed by authorised third-party payment processors. GoKenyaHub does not store full payment card details. By making a purchase you agree to the terms of the applicable payment processor.

6.3 Refund Policy

Due to the digital nature of our products:

• Digital downloads: No refunds once a file has been downloaded or accessed, except where the product is materially defective or not as described
• Subscription services: You may cancel at any time; access continues until the end of the current billing period; no partial refunds are issued
• Course enrolments: Refund requests submitted within 7 days of purchase and before completing more than 20% of course content may be considered at our discretion

To request a refund, email purchases@gokenyahub.com with your order reference and reason. We will respond within 5 business days.

7. Acceptable Use Policy

You agree not to use GoKenyaHub to:

• Upload, post, or transmit any content that is unlawful, fraudulent, defamatory, obscene, hateful, or discriminatory
• Harass, threaten, or intimidate other users or staff
• Attempt to gain unauthorised access to any part of the platform, other user accounts, or our servers
• Introduce malware, viruses, trojans, or any other malicious code
• Conduct automated scraping, crawling, or data harvesting without written consent
• Post spam, unsolicited commercial messages, or deceptive content
• Impersonate any person, entity, or GoKenyaHub staff member
• Use the platform in any manner that violates applicable local, national, or international law
• Post fraudulent job listings, fake visa guarantees, or misleading immigration advice

8. User-Generated Content

8.1 Your Content

When you post comments, blog replies, forum messages, or other content ("User Content"), you retain ownership of that content. By posting, you grant GoKenyaHub a worldwide, royalty-free, non-exclusive licence to use, display, reproduce, and distribute that content on the platform.

8.2 Content Standards

All User Content must comply with our Acceptable Use Policy (Section 7). Content that is spam, deceptive, harassing, or violates applicable law will be removed without notice.

8.3 Moderation

GoKenyaHub reserves the right — but is not obligated — to monitor, edit, or remove User Content at any time and for any reason, without notice or liability to you.

9. Intellectual Property

All content on GoKenyaHub — including but not limited to text, graphics, logos, CV templates, guides, course materials, software, and design — is owned by or licensed to GoKenyaHub and protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms transfers any intellectual property rights to you except for the limited licence granted in Section 5.1 for purchased digital products.

10. Disclaimers & No Guarantee

Our visa guides, salary information, and career resources are provided for informational and educational purposes only. They do not constitute legal advice. For immigration matters, we strongly recommend consulting a qualified immigration solicitor or an OISC-regulated adviser.

GoKenyaHub makes no warranty that:

• Use of our resources will result in a job offer, visa approval, or successful immigration outcome
• The platform will be error-free, uninterrupted, or secure at all times
• Information on the platform is always current or accurate — immigration rules change frequently

The platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

11. Limitation of Liability

To the maximum extent permitted by applicable law, GoKenyaHub and its directors, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, business, or goodwill
• Losses arising from reliance on our immigration guides or career resources
• Losses caused by third-party services linked to or integrated with GoKenyaHub
• Any unauthorised access to or alteration of your data (where you have not suffered direct financial loss due to our gross negligence)

Our total aggregate liability to you for any claims arising out of or relating to these Terms or the platform shall not exceed the total amount you paid to GoKenyaHub in the 12 months preceding the claim, or £50 (whichever is greater).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by English law.

12. Indemnification

You agree to indemnify, defend, and hold harmless GoKenyaHub and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the platform in breach of these Terms
• Your User Content
• Your violation of any applicable law or the rights of any third party

13. Suspension & Termination

13.1 By You

You may close your account at any time by contacting support@gokenyahub.com. Closure does not entitle you to a refund of any paid fees.

13.2 By GoKenyaHub

We may suspend or terminate your account immediately and without notice if:

• You breach these Terms or our Acceptable Use Policy
• We suspect fraud, abuse, or illegal activity
• Required to do so by law or court order

Following termination, your right to access the platform ceases immediately. Sections 9 (IP), 10 (Disclaimers), 11 (Liability), 12 (Indemnification), and 14 (Governing Law) survive termination.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales.

In the event of a dispute arising from or in connection with these Terms, we encourage you to first contact us at support@gokenyahub.com to seek an amicable resolution.

If a dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights as a consumer under Kenyan law where those laws apply.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Updating the "Last updated" date above
• Sending an email to your registered address at least 14 days before the changes take effect

Your continued use of GoKenyaHub after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the platform and close your account.
